Privacy Policy

TierPoint is committed to maintaining your confidence and trust and accordingly maintains the following Privacy Policy to protect the personal data (or information) you provide online. Information Collection

TierPoint will only collect your personal data (including but not limited to your name, email address, physical address, and/or telephone number) if you or your employer provides it voluntarily in person, via telephone, electronically via website, or email.

To grant physical access to our secure data center facilities and grounds, TierPoint collects personal data to authenticate and identify persons. This information includes:

  • Name, government-issued personal identification, and potentially vehicle plate information.
  • Business contact information and employer details, including business email address, business and if applicable mobile numbers.
  • CCTV footage and images capturing your presence near, entering/exiting and within our facilities.
  • Records of your data center access, including dates, times, and locations of physical entry, along with any relevant location.
  • Biometric data used for multi-factor authentication when entering our facilities.

TierPoint will only use your personal data for the purpose of conducting business, including offering employment opportunities at TierPoint, marketing campaign, and offering products and services by TierPoint and its affiliated third-party service providers. If you do not want your personal data to be collected by TierPoint, please do not submit it

Our Policy Toward Children

TierPoint does not knowingly collect personal data or target its sites and services to children under the age of eighteen. We encourage parents and guardians of children to not submit personal data about their children and to monitor their children’s online activity to prevent them from submitting personal data to TierPoint. If a parent or guardian becomes aware that his or her child has provided us with personal or contact information without their consent, he or she should contact us at [email protected]. If we become aware that a child under 13 has provided us with personally identifiable information, we will delete such information from our files immediately.

Retention Policy

TierPoint retains personal data for as long as necessary to meet the legitimate business purpose for which it is provided or allowed by applicable laws.  TierPoint use the following criteria to determine retention periods:

  • Our legitimate interest in processing personal data for business operations and contractual with you or your employer.
  • Restricted retention periods mandated by local law and regulations, such as:
    • CCTV recordings to protect the physical security of our data centers
    • Biometric data to secure our data centers with multi-factor authentication
    • Personal data of applicants during the recruitment process (subject to employment law restrictions that vary by state and country)
    • Any other processing of personal data with retention periods defined by local laws and regulations
  • A current or recent business relationship with you or your employer:
  • If TierPoint currently provides services, does business with, or with you or your employer.
  • If you or your employer have interacted with TierPoint or its services within the last three years.
  • Compliance with legal obligations:
    • Statutory minimum retention periods for business records, administrative, and tax requirements.
  • Securing TierPoint’s legal position:
    • Preserving evidence during an applicable limitation period under law, which may involve retaining personal data relevant for defending TierPoint’s interests in legal proceedings.
  • Upon expiration of the retention, TierPoint will permanently and securely erase, destroy, or anonymize the relevant personal data.

In some circumstances, however, we may retain Personal Data for longer periods of time, including where we are required to do so in accordance with legal, tax and accounting requirements or if required to do so by a legal process, legal authority, or other governmental entity capable of making this request. In accordance with the Access Section below, you may request that your information is deleted at any time.

Cookies

TierPoint may employ the use of “cookies” in the process of marketing and advertising through third-party companies. Cookies are small text files placed on your device to store data that can be recalled by a web server in the domain that placed the cookie. Cookies do not store any information that you have provided outside of forms you purposely fill in. You can delete cookie files from your hard drive at any time or avoid cookies by configuring your browser to reject them or to notify you when a cookie is being placed on your hard drive.

Information Use

TierPoint only uses the information which is provided through this website to help improve TierPoint’s services, to provide you with the products you have requested, to inform you about additional products or services that may be of interest to you, for marketing purposes, and for other internal purposes.

 

TierPoint does not sell, trade, or rent your personal data to entities other than TierPoint affiliated companies and their advertising and promotional agencies and consultants.

Information Sharing with Third Parties

TierPoint may provide personal data to third parties a) to assist the development of and provision of TierPoint related products and services to you and b) to establish accounts, billing, collection of payment, enforcing TierPoint Term and Conditions and/or the Acceptable Use Policy services where permitted by law, and protecting or enforcing our ability and rights to protect our other customers from fraudulent, abusive, or unlawful, use by you of our services c) to comply, in accordance with the law, with court orders, civil or criminal subpoenas, and law enforcement, legal and governmental investigations.

Individuals have the right to access the Personal Data processed about them and subject to applicable laws, individuals may request access to their Personal Data processed by contacting TierPoint using the following methods:

 

For customers and customer contacts, you can review the contact information within the TierPoint’s support Portal at https://login.tierpoint.com/. Customers, prospects, users of TierPoint’s website, and other interested person, may contact TierPoint via email at [email protected], call (844) 859-8437 or mail at the physical address listed below. If you would like to opt out of third-party advertising, please visit: https://optout.aboutads.info/.

 

Subject to applicable law, you may also have other rights available related to your Personal Data including the right to:

  • choose to “opt out” of any third-party sharing of personal data (unless it was obtained in accordance with the “Use of Information” above) or the use of the personal data contradicts or is incompatible with the use for which it was collected.
  • obtain a copy of your Personal Data together with information about how and on what basis that Personal Data is processed;
  • rectify inaccurate Personal Data (including the right to have incomplete Personal Data completed);
  • erase your Personal Data (in limited circumstances, such as where it is no longer necessary in relation to the purposes for which it was collected or processed);
  • restrict processing of your Personal Data under certain circumstances;
  • to withdraw your consent to our processing of your Personal Data (where that processing is based on your consent); and
  • to obtain or see a copy of the appropriate safeguards under which your Personal Data is transferred to a third country or international organization.

Security

TierPoint has implemented security features throughout the TierPoint website to prevent the unauthorized release of or access to personal data. Database information is kept separate from live servers and is firewall protected. However, please be advised that although TierPoint has endeavored to create a secure and reliable site for you, the confidentiality of any communication or material transmitted to or from TierPoint via the TierPoint website or e-mail cannot be guaranteed. When disclosing any personal data via insecure methods, you should be mindful of the fact that it is potentially accessible to the public, and, consequently, personal data can be collected and used by others without your consent. TierPoint has no responsibility or liability for the security of information transmitted via the Internet.

Data Privacy Framework Dispute Resolution

To the extent hyperlinks or banner advertisements incorporating hyperlinks are utilized to access third party websites, you should be aware that these third-party websites are not controlled by TierPoint and, therefore, are not subject to this Privacy Policy. You should check the privacy policies of these individual websites to see how the operators of those third-party websites will utilize your personal data.

Data Privacy Framework

TierPoint complies with the EU-U.S. Data Privacy Framework (DPF) Principles (“Principles”) formerly the EU-US Privacy Shield; as part of this, we have self-certified via the site administered by the International Trade Administration on behalf of the US Department of Commerce, that we adhere to the Principles of: Notice; Choice; Accountability for Onward Transfer; Security; Data Integrity and Purpose Limitation; Access; and Recourse, Enforcement, and Liability, with respect to processing personal data on behalf of our Customers established in the European Union.

 

You can learn more about the DPF at www.dataprivacyframework.gov and see our self-certification at  www.dataprivacyframework.gov/list. TierPoint’s self-certification to the DPF is subject to the investigatory and enforcement authority of the Federal Trade Commission. TierPoint continues to monitor updates to the DPF and any new regulatory changes impacting it.

California Consumer Privacy Act (CCPA)

TierPoint is committed to protecting sensitive information shared with it, including the personal data of California residents. TierPoint has information management policies to protect information, including security, access controls, classification of information, privacy and data protection, and other relevant policies and standards governing the collection, use, disclosure, transfer, retention, and deletion of sensitive information.

 

As a “Service Provider” as defined in the CCPA, TierPoint will not sell, retain, use, and/or disclose Personal data for any purpose other than what is set forth in the agreements with our customers or those business purposes permitted by CCPA.

Your Consent and Revisions to this Privacy Policy

By using TierPoint’s website, you consent to the collection and use of this information by TierPoint. TierPoint reserves the right to revise this Privacy Policy at any time. Any revisions to this Privacy Policy will be posted on this page. We encourage you to periodically review the Policy and note any changes.
